OUR ROLE IN DATA PROCESSING

The entity responsible for the collection and use (processing) of your personal information is Fast Global Solutions, Inc. which, for the purpose of the General Data Protection Regulation (“GDPR”) and the UK Data Protection Act 2018 (“DPA”), is the data controller. The Website is controlled and operated by us from the United States of America (“U.S.”) and we collect data from you directly from the U.S. Please be aware that in accordance with U.S. laws, in certain circumstances which may be different than those in your country of residence, U.S. courts, law enforcement agencies, regulatory agencies, or security authorities may be entitled to access your personal data.

PERSONAL INFORMATION WE COLLECT, WHY AND FOR HOW LONG

We collect personal information, which is information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, to you, when you interact with us in your capacity as a representative/employee of our customer or potential customer. As used in this Privacy Notice, “personal information” includes “Personal Data”, as defined under the GDPR and DPA. We will retain your information for as long as necessary for the purpose of the processing as more specifically set forth in this Privacy Notice, unless we receive a request to delete this information and no exception to your right to deletion applies.

We collect personal information when you:

  • Communicate via telephone or email. ou contact us via telephone or email, we collect, from you, your personal identifiers (name, business email address, and business telephone number) and any information you choose to include in your message. We use this information to respond to your questions or inquiries, conduct business with you, and troubleshoot where necessary. To the extent the EU or UK data protection laws apply, the legal basis for this processing is that it is necessary for the performance of the service requested by you.
  • Contact us via the Contact Us portion of our website. When you contact us via the contact form on the Website, we collect, from you, your personal identifiers (name, business email address, and business telephone number), employer information (name of employer and role), and any information you choose to include in the comment field. We use this information to respond to your questions or inquiries, troubleshoot where necessary, and manage your use of the Website. To the extent the EU or UK data protection laws apply, the legal basis for this processing is that it is necessary for the performance of the service requested by you.
  • Sign up for Newsletter. When you subscribe to our email Newsletter, we collect your personal identifiers (name, email address, contact type). We use this personal information to fulfill your request to receive email alerts with our company newsletter.  We keep this information for as long as you want to receive email marketing communications from us, or 10 days after you opt-out of marketing emails from us, or earlier if we have received a request to delete this information, unless an exception applies.  We will share your identifiers (name and email address) with our email marketing provider to send you the marketing emails. To the extent EU or UK data protection law applies, the legal basis for processing this information is consent. You can unsubscribe at any time by clicking on the “unsubscribe” link in each email. Please note that we will continue to send you notifications necessary to the services or requested products or services. Our communications contain tracking technologies, to analyze whether a predefined action took place by a recipient, such as opening our communications, in order to better adapt and distribute our communications. , for residents of the US, you will be automatically opted in to the use of these technologies. You can disable tracking by disabling the display of images by default in your email program. To the extent EU data protection law applies, the legal basis for this is your consent.
  • Interact with us on social media. When you interact with our fan page on social networking websites, such as Facebook, Twitter, LinkedIn, and Instagram (each a “Fan Page” and collectively “Fan Pages”), we collect basic engagement metrics and use it to tailor content and marketing and use it to improve user experience as set forth in this section. Please note that we do not control the use or storage of the information that you have posted to any social networking websites. This information is collected and processed by the social networking websites for their own purposes, including marketing. For more information on how Facebook, Twitter, LinkedIn, and YouTube use your personal information, please see Facebook’s Privacy Policy, Twitter’s Privacy Policy, and LinkedIn Privacy Policy.Facebook, Twitter, LinkedIn, and Instagram (the “Social Networks”) process personal information in the USA where the laws may be less protective than in your country of residence. For example, in accordance with U.S. laws, in certain circumstances, courts, law enforcement agencies, regulatory agencies, or security authorities in other countries may be entitled to access your personal data.
  • Fan Pages. When interacting with our Fan Pages, we collect, from you, your personal identifiers (first and last name) and visual information (photograph (i.e., profile picture)), as well as any information that you provide when interacting with our Fan Pages (e.g., commenting, sharing, and rating). We use this information to advertise our products, for events and invitations, and to communicate with users via the contribution and comment function. To the extent the EU or UK data protection laws apply, the legal basis for the processing is our legitimate interest in advertising our products via our Fan Pages and communicating with users, customers, and interested parties. Because our Fan Pages are publicly accessible, when you use them to interact with other users, for example by posting, leaving comments or liking or sharing posts, any personal information that you post in them or provide when registering can be viewed by others or used by them as they see fit. The content posted on our Fan Pages or other public areas of social networking websites can be deleted in the same way as other content that you have created. If at any time you want content posted to be deleted, please email your request to us at Fast Global Solutions’ email address.
  • Community Management. We collect, from you, your contact, including "likes", shares, messages and other interactions with the content, in order to analyze and evaluate how our content is perceived, to learn from it, and to improve our public relations efforts. To the extent the EU and UK data protection laws apply, the legal basis for analyzing your content is our legitimate interest in organizing, facilitating, and optimizing communication with our users and the general public. If you object to this processing of your personal information and believe you have an overriding interest, you can submit your objection via email to Fast Global Solutions’ email address.
  • Events and Photos. When you register for an event on our Fan Pages, we collect, from you, your personal identifiers (first and last name, email address, telephone number, physical address, and any other information you provide). We use this information to create and manage the event (e.g., to create the guest list, accreditation and admission control, room and personnel planning, planning the catering) as well as to send you your invitation and notifications about the event. We also use this information for prevention of fraud and defense against legal claims. To the extent the EU or UK data protection laws apply, the legal basis for processing your information to facilitate your attendance is the necessity for the performance of a contract with you. If you do not provide this information, you would not be able to participate in the event. The legal basis for the other uses is our legitimate interest in fraud prevention.  At events for which you have registered, photos and video recordings may be made (possibly by a photographer commissioned by us), in which you may also be shown. If you are the central subject of a recording, the photographer will ask you before the recording/taking the photo whether you agree and consent. We use the photos for our public relations and marketing on our various media/digital media outlets. To the extent the EU or UK data protection laws apply, the legal basis for processing your photos where you are the subject is your consent. You can revoke your consent with effect going forward via email to Fast Global Solutions’ email address. The legal basis for taking and publishing photos where you are in the background is our legitimate interest in public relations. If you object to this processing of your personal information and believe you have an overriding interest, you can submit your objection via email to Fast Global Solutions’ email address.
  • Page Insights. When you visit our Social Network Page, the Social Network records your IP address and other information about your usage behavior on our Social Network Fan Page. The Social Network collects, through trackers in the browser of your device or via the advertising ID (IDFA from Apple or GAID from Google), when you open the Social Network app through your mobile device (e.g., smartphone or tablet). Social Network uses this information to provide us with statistical evaluations of the use of our Social Network Fan Page. We receive this information directly from Social Network, in the form of aggregated data and anonymous statistics regarding certain data points, such as: age; gender; city/country; device; inquiries from fans about other Social Network fan pages; region and language settings of the users; proportion of men and women; the number of people reached; clicks on posts, "Likes” and reactions; comments and shared content; and total video views. We use this information to analyze and improve the advertising campaigns we conduct through our Social Network Fan Page. We do not collect or process any other personal information in connection with Social Network “Page Insights” function.To the extent the EU and UK data protection laws apply, we are joint controllers with the Social Network for this processing. For the purpose of the EU and UK data protection laws, the legal basis for this processing is our legitimate interest in statistical evaluation of users on our Social Network Fan Page for the improvement and adjustment of our advertising measures based on the information collected. If you object to this processing of your personal information and believe you have an overriding interest, you can submit your objection via email to Fast Global Solutions’ email address.We do not retain this information independently. For information on data protection and the storage period on the Social Network in relation to its Insights function, see the Social Network privacy policy linked above. It has been contractually agreed with the Social Network that the Social Network is responsible for providing you with information about the processing for Page Insights.
  • Information Processed Solely by Social Networks. We do not know how the Social Networks use personal information for its own purposes, how long the personal information is stored on the Social Network or whether the Social Network data is passed on to third parties. If you are currently logged in to a Social Network as a user, the Social Network automatically collects, through trackers on your device, your Social Network ID or a link between the Social Network ID and the advertising ID (IDFA from Apple or GAID from Google) when you open the Social Network app through your mobile device (e.g., smartphone or tablet). This enables the Social Network to understand that you have visited our Social Network Fan Page along with other Social network pages that you have clicked on, whether you clicked on Social Network buttons integrated into websites that partner with the Social Network, and other online interactions that report user data to the Social Network. Based on this data, content or advertising tailored to you can be offered. You can find more information about the personal information collected by Social Networks, how it is used and how long it is stored by visiting the Social Network’s privacy policies, linked above.
  • Interact with us at industry trade shows. You may interact with us at industry trade shows (“Field Marketing Activations”). When you interact with us here, we collect, from you, your personal identifiers (name, business email address, and business telephone number), employment information (role/position, and employer name). We use this information to send you marketing e-mail communications, updates, news, and special offers (see above for privacy practices related to our email newsletter).  To the extent the EU and UK data protection laws apply, the legal basis for this processing is your consent to receive promotional marketing messages from us. You can opt out of email marketing communications at any time by clicking on the “unsubscribe” link included in the email you receive from us.
  • Interact with the Website. In addition to the personal information you provide directly to us, we also collect your internet and other network activity information from you automatically as you use the Website via “cookies”, pixels, and similar tracking technologies. For more information on these cookies, including a list of third-party marketing and analytics cookies, visit our Cookie Policy.   • Google Analytics. We use Google Analytics to collect information on your use of the Services for its improvement.   • YouTube. We use YouTube (owned by Google) as our video platform to embed content from YouTube on our Website. YouTube uses these cookies to track viewing statistics and assign a unique identifier to the device on which the video is viewed, enabling YouTube to recognize the device. This data is collected by Google.  Google can use this data to show relevant advertising and for its own promotional purposes in accordance with Google’s.  The Google cookies also allow YouTube and its partners to show you advertisements on and outside of YouTube. DATA RETENTION

We use the following criteria to determine whether it remains reasonably necessary to retain your personal information for one or more disclosed operational purpose, or a service provider or contractor’s operational purpose(s): (i) whether there is a retention period required by statute or regulations; (ii) the existence of actual or threatened litigation for which we are required to preserve the information; (iii) the statutes of limitations for potential legal claims; and (iv) generally accepted best practices in our industry, including related to safety and security of our properties and assets. When we determine that it is no longer reasonably necessary to retain your personal information for one or more disclosed operational purposes based on the above criteria, we will delete your personal information.  

HOW WE SHARE YOUR PERSONAL INFORMATION

A. General Sharing

Fast Global Solutions shares personal information in the following instances:

  • Within Fast Global Solutions. We share your personal information within Fast Global Solutions for the legitimate business purposes of efficiently and effectively providing the Services, such as accounting and customer service support. Access to your personal information is limited to those on a need-to-know basis. To the extent EU or UK data protection law applies, the legal basis for this is our legitimate interest in providing the Services more efficiently.
  • In the event of a corporate reorganization. In the event that we enter into, or intend to enter into, a transaction that alters the structure of our business, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our business, assets or stock, we would share personal information with third parties, including the buyer or target (and their agents and advisors) for the purpose of facilitating and completing the transaction. We will also share personal information with third parties if we undergo bankruptcy or liquidation, in the course of such proceedings.   • For legal purposes. We share personal information where we are legally required to do so, such as in response to court orders, subpoenas, governmental/regulatory bodies, law enforcement or legal process, including for national security purposes. We may share your information with our legal advisors or auditors to establish, protect, or exercise our legal rights or as required to enforce our terms of service or other contracts or to defend against legal claims or demands. We also share this information with third parties as necessary to: detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person; to comply with the requirements of any applicable law; or to comply with our legal obligations.   • With service providers. We share personal information with service providers that assist us in providing the Website. These service providers assist us with functions such as: IT support, email marketing service providers, event lead management provider, HR applicant processing service provider, digital marketing providers, customer relationship management providers, and payment processors.
  • With your consent. Apart from the reasons identified above, we may request your permission to share your personal information for a specific purpose. We will notify you and request consent before you provide the personal information or before the personal information you have already provided is shared for such purpose.  For a business purpose. In the preceding twelve (12) months, Fast Global Solutions has disclosed the following categories of personal information for a business purpose to the following categories of third parties.

  • We have disclosed your personal information to service providers that assist us in providing the Website. These service providers assist us with the following: IT support; website hosting; data analysis; customer service; email delivery; auditing; and similar services.
  • We have disclosed your internet or other electronic network activity information collected by cookies to our IT support to detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and to identify and repair the Website and platform.
  • We have disclosed your internet or other electronic network activity information collected by cookies to our IT support to update, improve, and maintain the Website and platform.

RIGHTS OF INDIVIDUALS IN THE EEA AND UNITED KINGDOM

Individuals in the EEA and UK are entitled certain rights to their personal data under applicable law. To the extent these laws apply to our processing of your personal data, you are entitled to the following rights:

  • Right to access: You have the right to ask us for copies of your personal data, which extends to email marketing, electronic communications, information gather from interacting with our Website and information gathered at Field Marketing Activations.. This right has some exemptions, which means you may not always receive all the personal data we process. Applicable exemptions may include the management information exemption (data that we process for management forecasting or management planning about a business or other activity), confidential references (references given or received about an individual), or certain instances of ongoing or prior negotiations with the requestor, among others.
  • Right to rectification: You have the right to ask us to rectify personal data you think is inaccurate. You also have the right to ask us to complete information you think is incomplete. This extends to information collected by your interactions with us through online communications, data gathered through your interactions with our website, your interactions with us on Social Media, your interactions with us at Field Marketing Activations, and to information gathered in person or offline. 
  • Right to erasure: When we use cookies and other trackers on our Website, send you marketing emails, or process your personal data collected from an event that you attended, a Field Marketing Activation, you have the right to request erasure of your personal data that we are not obligated to keep in some cases (also known as the right to be forgotten).   • Right to object to processing: When you interact with us directly or indirectly through the Social Networks, you have the right to object to processing of your personal data if based on our legitimate interest, by referencing your personal circumstances. This right does not apply to information what may be needed to our legal obligations or, for Field Marketing Activations where such information is necessary to provided services.
  • Right to data portability: You have the right to ask that we transfer the personal data you gave us from one organization to another or give it to you. However, this right only applies when: (i) you have provided your personal data to us; (ii) the legal basis for the processing is your consent or for the performance of a contract; and (iii) the processing is carried out by automated means. Therefore, you can invoke this right for the processing of the information we automatically collect from you as you interact with the Website via “cookies”, pixels, and similar tracking technologies as well as when you communicate with us through electronic means, you interact with us through our Contact Us portion of our Website, sign up for our Newsletter, interact with us on Social Media, and at a Field Marketing Activation.

Right to lodge a complaint: You have the right to lodge a complaint with the relevant Supervisory Authority.

RIGHTS OF CALIFORNIA RESIDENTS

The California Privacy Rights Act (“CPRA”) entitles California residents to certain rights. To the extent these laws apply to our processing of your personal information, you are entitled to the following rights:

  • Right to Access/Know. You have the right to request what personal information we have collected, used, disclosed, and sold about you, unless doing so proves impossible or would involve disproportionate effort. You may only make a request for access twice within a 12-month period.
  • Right to Deletion. You have the right to request the deletion of your personal information that we collect or maintain, subject to certain exceptions. For example, if we are required by law to retain the information that you are asking be deleted, we would not be able to delete the information until we are legally permitted to delete it.
  • Right to Opt Out of Sale/Sharing. You have the right to opt out of the sale or sharing of your personal information to third parties. Fast Global Solutions does not have actual knowledge that it sells or shares personal information of minors under the age of sixteen (16) years.
  • Right to Non-Discrimination. You have the right to not receive discriminatory treatment if and when you exercise your rights to access, delete, opt out, correct, or limit use of sensitive personal information under the CPRA.
  • Right to Correct: You have the right to correct inaccurate personal information that we collect or maintain.
  • Right to Limit Use of Sensitive Personal Information: You have the right to limit the use of your sensitive personal information when such use goes beyond that which is necessary for providing the Services or certain other permissible purposes like fraud, customer service or quality control. Sensitive information includes Social Security number, driver’s license number, biometric information, precise geolocation, and racial and ethnic origin. Fast Global Solutions does not use sensitive information collected through the Services in this manner.

To exercise your rights, you may submit a request by completing our webform, or by contacting us toll-free at 833-520-8800. To opt out of the sale or sharing of your personal information via cookies, please visit Do Not Sell or Share My Personal Information or utilize the opt out preference signal to instruct us to not sell or share any of your personal information collected online. The opt out preference signal will apply to the device, platform, or browser in which you utilize it. You can utilize the opt out preference signal by turning on the signal in your device, platform, or browser settings. For requests submitted via telephone, you must provide us with sufficient information that allows us to reasonably verify you are the person about whom we collected the personal information (by providing your name, email address, telephone number, and employer name) and describe your request with sufficient detail to allow us to properly evaluate and respond to it. In doing so, we will take steps to verify your request by matching information provided by you with the information we have in our records. If we are not able to verify your identity for access and deletion requests with the information provided, we may ask you for additional pieces of information.

Only you, or a person that you authorize to act on your behalf may make a request related to your personal information. If you are an authorized agent making a request on behalf of another individual, you must provide us with signed documentation that you are authorized to act on behalf of that individual.

CROSS BORDER TRANSFER

Fast Global Solutions’ headquarters are located in the United States. We store information in the United States. We may transfer your personal information to recipients in countries outside of the European Economic Area or the UK that may have differing data protection laws. This includes countries which the EU Commission and UK does not consider to have an adequate level of protection for personal data. If this occurs, we will ensure there is a legal ground for the transfer in accordance with applicable data protection legislation. You will also be informed about the legal ground, what safeguards were implemented, and where you can obtain a copy of information on these safeguards.

DO NOT TRACK

We do not respond to Do Not Track requests. Do Not Track is a preference you can set in your web browser to inform websites and mobile applications that you do not want to be tracked. You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.

INFORMATION SECURITY
